These terms and conditions apply to the activities at Tree Surfers, including the Ropes Course, the Tree Jump and the Canopy Zip Tour.
Tree Surfers is a trading name for Dartmoor Outdoor Company Ltd whose registered office is at Woodlands Gulworthy Tavistock Devon PL198JEand whose registered company number is 05583971.
Tree Surfers reserves the right to make alterations to the activities provided.
Safety
The activities at Tree Surfers are physically, mentally and emotionally challenging. Participation in the activities at Tree Surfers entails some risk of injury. A fall from the course could be fatal. All staff employed by the company are trained and appropriately qualified to supervise activity sessions.
The Company will at all times seek to limit the risk of injury or death. However the Customer accepts that accidents and injuries can happen.
Customers need to accept that all individuals must be responsible for their own actions and safety and the safety of others on the activity. Both Company and Customer agree to take all reasonable steps to ensure the safety of all concerned with the activity.
Customers will be given a safety briefing by an instructor prior to starting the activity. Instructors will not be directly supervising customers after the safety briefing. Children of 12 years and under must be supervised by an adult; one adult can supervise 2 children under 12 years old. Children under 8 years old are not permitted on the ropes course.
The activies at Tree Surfers are located within a wild environment where there are natural hazards and risks, both on the ground and on the activities within the trees. The Company has made every effort to manage those risks; however participants must take responsibility for their own actions particularly when walking through the woodland, along tracks and paths.
Booking
Bookings are deemed to be accepted by Tree Surfers once Tree Surfers has accepted the booking in writing, including email. Booking cannot be made without accepting these terms and conditions.
Full payment shall be made at the point of booking
It is the customer’s responsibility to ensure they have booked the correct time for each activity and that they arrive with sufficient time. It is also the responsibility of the customer to ensure that they have allowed enough time between each activity.
Late arrivals of more than 5 minutes will forfiet their place on the course and still be charged the full price.
Cancellations by the Customer
A full refund will be given when Customers cancel their booking 48 hours in advance of the start time of the booked activity. Cancellations must be made by email to [email protected] or by phone to 01822 833409
Cancellations by the Company
Whilst every attempt is made to ensure that the activities are available, the Company will notify the Customer of cancellation as soon as practicable where it believes on reasonable grounds that cancellation is necessary due to dangerous and/or unsuitable conditions for the activity.
Customers will be entitled to a full refund in the event of the Company cancelling the activity, but will not be entitled to any compensation.
Liability
Vehicles are parked and left at the risk of the vehicle owner including any payment due in respect of the parking.
The Company does not accept any responsibility for the loss or damage to any property belonging to Customers whilst on site or participating in the activities.
Competition Terms and Conditions
1.) To apply for free tickets please visit (www.treesurfers.co.uk) and complete the enquiry form. Please remember to enter the relevant promotional code. 2.) The closing date to enter the prize draw is Wednesday 17th June 2009. 3.) No purchase is necessary. Only one entry per person and per household. 4.) In the event of non-acceptance or the person being not contactable, Tree Surfers reserves the right to reallocate the prize to the next valid entry or to forfeit the prize. 5.) By entering the prize draw, the winner (s) consents to take part in any publicity accompanying or resulting from this promotion, and for his/her name and county to be used for publicity purposes by Tree Surfers in printed and/or online formats. 6.) The competition is open to all UK residents aged 13 or over (height restriction of 1.4m applies), other than employees of Tree Surfers, The Marketing-PR Company, or its agencies. Entries received from third parties or agents will not be entered into the prize draw. 7.) No cash value and non-refundable. 8.) It is a condition of entry that the terms and conditions of the prize draw are accepted as final and that entrants agree to abide by the rules. No correspondence will be entered into. 9.) Tree Surfers will not accept responsibility for loss of entries through incomplete, illegible or other damaged entries. Proof of entry is not automatically proof of receipt. 10.) In the event of unforeseen circumstances Tree Surfers reserves the right to offer alternative prizes of equal or greater value. 11.) Tree Surfers will draw the prize from entrants who have provided their contact information. Tree Surfers will not pass that information onto third parties. 12.) The winner (s) will be notified by e-mail as soon as possible after the closing date.
